Article 1.
This tariff fixes the amount of remuneration for cable retransmission of music works from the repertoire of Sokoj (hereinafter: the repertoire) as well as the conditions for use of repertoire, term and mode of payment of remuneration and circumstances which effect the increase or decrease of remuneration.
Article 2.
Repertoire consists of the music works:
1) by domestic authors and right holders, members of Sokoj, who have by contract renounced their rights to Sokoj, on the basis of the article 153 of the Copyright and Related Rights Act;
2) by domestic authors and right holders, members of Sokoj, whose rights are protected by Sokoj, on the basis of the article 180 of the Copyright and Related Rights Act;
3) by foreign authors and right holders, members of Sokoj, whose rights are protected by Sokoj, on the basis of the article 186 of the Copyright and Related Rights Act;
Article 3.
For use of repertoire cable operators are obliged to:
- obtain license from Sokoj by concluding contract about non-exclusive renouncing right of broadcasting the repertoire;
- deliver to Sokoj data about the number of connections, with the situation on the 1st day of the month for which remuneration is paid, at the latest until the 5th day of the month for the previous month;
- deliver to Sokoj the list of channels with full names of channels and indication of country of origin, with the situation on the 1st day of the month for which remuneration is paid, at the latest until the 5th day of the month for the previous month;
- pay author's remuneration, as per invoice of Sokoj, monthly, within five days from the receipt of the invoice.
Article 4.
Remuneration for cable retransmission of music works from the repertoire of Sokoj is RSD 0,38 (excluding VAT), by connection, by channel, monthly, i.e. RSD 4,57 by connection, by channel, yearly in 2010.
Remuneration for the following years will be fixed through harmonizing the remuneration agreed on in 2010 with the increase in retail prices and on the basis of official data of Republic Institute of Statistics.
Article 5.
In case of the growth of retail prices for over 5% during one month, change of price which cable operators request from subscribers or in case of any other changes which would affect the level of agreed remuneration, remuneration will be determined by amendment of tariff agreement.
Article 6.
In case that cable operators do not deliver on time relevant data for settlement, Sokoj will fix compensation as advance payment amount.
Article 7.
In case that cable operator reports within determined time limit, relevant data for settlement and pays remuneration in full amount as per invoice of Sokoj, 5% discount will be approved on the amount of remuneration.
Article 8.
Remuneration will be reduced also by the number of reported connections, and that is for:
- 1% for 5.000 to 15.000 reported connections,
- 2% for 15.000 to 35.000 reported connections,
- 3% for 35.000 to 75.000 reported connections,
- 4% for 75.000 to 150.000 reported connections and
- 5% for more than 150.000 reported connections,
on condition that cable operator reports within determined time limit, relevant data for settlement and pays remuneration in full amount as per invoice of Sokoj.
Article 9.
Remuneration will not be calculated for TV channels for which is established status of
"public service" and which are cable operators obliged to retransmit free of charge, without compensation.
Article 10.
Cable operators are obliged to make possible for Sokoj wide control of documentation which refers to the number of connections, as well as the name and number of transmitted channels, through representatives appointed by Sokoj.
Article 11.
This tariff comes into force on the eighth day from publishing in "Official Herald of Republic of Serbia"
