Sokoj - Serbian Music Authors' Organization from Belgrade, Mišarska St. no. 12-14 (Sokoj) and Broadcasting Institution of Vojvodina "Radio Television of Vojvodina" from Novi Sad, Innjata Pavlasa St. no. 3 (BIV), have, on the day of April 20, 2010, concluded Agreement about the Tariff on Remunerations for Use of Music Works from the repertoire of Sokoj on the bases of broadcasting and on the basis of the article 174 paragraph 4 of the Copyright and Related Rights Act ("Official Herald of RS" number 104/09),

This tariff fixes the amount of remuneration for broadcasting of music works from the repertoire of Sokoj (hereinafter: the repertoire) on radio and TV programs of Broadcasting Institution of Vojvodina "Radio Television of Vojvodina" (BIV) as well as the conditions for use of repertoire, term and mode of payment of remuneration and circumstances which effect the increase or decrease of remuneration.


Repertoire consists of the music works:

1) by domestic authors and right holders, members of Sokoj, who have by contract renounced their rights to Sokoj, on the basis of the article 153 of the Copyright and Related Rights Act;

2) by domestic authors and right holders, members of Sokoj, whose rights are protected by Sokoj, on the basis of the article 180 of the Copyright and Related Rights Act;

3) by foreign authors and right holders, members of Sokoj, whose rights are protected by Sokoj, on the basis of the article 186 of the Copyright and Related Rights Act;


For use of repertoire BIV is obliged to:

- obtain license from Sokoj by concluding contract about non-exclusive renouncing right of broadcasting the repertoire;

- deliver to Sokoj data about the participation of music repertoire in the total duration of program, separately for TV channels and separately for radio channels;

- deliver to Sokoj, before the 5th day of the month, data about realized income, with separated grounds of acquisition and that is - the data about income paid on the basis RTV subscription and the data about realized income from marketing;

- deliver the copy of certified Balance sheet from final financial statement, at the latest until March 15 of the current year for the previous year, together with the relevant financial and other documentation from which the ground for settlement of remuneration may be reliably established;

- deliver, in legal form the list of broadcasted music works which contains the titles of music works, names of authors and coauthors, as well as the duration of performance and

- pay author's remuneration, as per invoice of Sokoj, monthly, until the end of the current month for the previous month.


Ground for settlement of remuneration consists of the income paid on the basis of RTV subscription and income realized from marketing reduced for the amount of PTT expenses, and for costs of Electrical Industry of Serbia necessary for collection of remuneration and for the amount which is being deducted as per Film Industry Act;

For separation of income from radio, i.e. TV, is applied relation of participation of expenses of BIV intended for production and broadcasting of radio program, i.e. television program.


Remuneration may be fixed on monthly level, as an advance payment, on the basis of the data about income realized in the previous business year, i.e. on the basis of the income for the last month for which BIV has reported information about realized income.


Remuneration is fixed according to realized income and the percentage is fixed in accordance with the participation of music repertoire in the total duration of program.

Sokoj will make final settlement of remuneration for one business year on the basis of final financial statement of BIV and the financial and other documentation.


Sokoj will approve discount of 10% if BIV concludes contract with Sokoj and if, within agreed time limits:

- reports relevant data for settlement of remuneration,
- delivers credible lists of broadcasted works in the form foreseen by Sokoj and
- pays the whole amount of remuneration as per Sokoj's calculation.


Remuneration fixed by this tariff is applied conclusive with December 31, 2010, and for each coming year, in the period of three years, remuneration is increased for 0,10% per year.


This tariff comes into force on the eighth day from publishing in "Official Herald of Republic of Serbia"
